Advance Notice for Planning Commission & Board of Supervisors

Here is the advance notice for the Planning Commission & Board of Supervisors and Board of Zoning Appeals.

The following will be heard at the March 11, 2013 Planning Commission meeting. The Board of Zoning Appeals will not meet in March. The Board of Supervisors meeting will be held March 26, 2013.

Public Hearings: Planning Commission/Board of Supervisors

Amsterdam Magisterial District: New Orchard Marketplace, LLC, requests a Change of Proffers to remove the requirement for sidewalks from Marketplace Drive located within Orchard Market Place, approximately 0.49 miles north of the U.S. Route 220 (Roanoke Road)/State Route 779 (Catawba Road) intersection, adjacent to parcels shown on the Real Property Identification Maps of Botetourt County as Section 101(17) Parcels 7, SW2, 6, 9, 5, 1; Section 101, Parcel 109.

Blue Ridge Magisterial District: Roger L. and Kathy B. Haynes request a Special Exception Permit, with possible conditions, for an additional accessory building in excess of the number permitted in Section 25-125, Building Requirements of the Botetourt County Zoning Ordinance in the Residential (R-1) Use District. The 1.294-acre lot(s), located at 47 Woodlawn Court (State Route 1438), and approximately 0.05 miles east of its intersection with Woodlawn Avenue (State Route 1435) in Blue Ridge, identified on the Real Property Identification Maps of Botetourt County as Section 109E(3) Parcels BK 3-7 and 3-8.

Text Amendment and Definition: Grain Silo, Commercial, is a structure used for storing grain produced off premises for distribution to final processing plants and markets. Grain silo, commercial, may not be used for the storage of other dry bulk materials such as ores, coal, wood chips, sand, gravel, stone or like products in loose bulk form, manure or silage.

Buchanan Magisterial District: A request for a Zoning Ordinance Text Amendment, Definition, and Change in Proffers by Lawrence Investments LLC, with Gene R. and Phyllis S. Simmons on parcels of land identified as a portion of tax map number(s) 76-24, 76-24A and 76-24B, specifically the .811 acres, more or less, zoned B-3 Business District, and more fully shown on that certain “Plat of Part of the Property of Gene R. & Phyllis S. Simmons showing .811 acres to be rezoned”, dated June 6, 1997, prepared by Charles R. McMurry, Certified Land Surveyor, a copy of which is recorded in the Clerk’s Office of the Circuit Court of Botetourt County, Virginia in Deed Book 543, Page 114 AND all of that certain tract or parcel of land containing 0.322 acres, more or less, as more fully shown on that certain “Plat of Part of the Property of Gene R. & Phyllis S. Simmons”, dated June 6, 1997, prepared by Charles R. McMurry, Certified Land Surveyor, a copy of which is recorded in the Clerk’s Office of the Circuit Court of Botetourt County, Virginia in Deed Book 302, Page 59. The request is to establish a definition of a grain silo, commercial in Botetourt County Code Chapter 25, Zoning and establish potential use regulations for grain silo, commercial, in Botetourt County Code Chapter 25, Zoning in Botetourt County, VA. The remaining portion(s) of parcel(s) 76-24, 76-24A, and 76-24B, remains Agricultural, A-1 and will not be affected by this Change in Proffer request.

Fincastle Magisterial District: Richard D. & Robin K. Thompson along with Twin River Outfitters request a Special Exception Permit, with possible conditions, in the Agricultural (A-1) Use District to operate a seasonal, primitive campground on an approximately eight acre portion of their 158.25-acre property located on Thompson Drive at its intersection with Botetourt Road (U. S. Route 220) approximately 1.98 miles north of the Botetourt Road/Narrow Passage Road (Route 43) intersection bounded on the eastern side by the CSX Railroad line, on the southern and western side by the James River, and by Mill Creek on the northern boundary, identified on the Real Property Identification Maps of Botetourt County as Section 18, Parcel 4.
