By popular demand, a Spanky-Macher-is-busted thread

That is yours truly on the left, with Spanky Macher on the right, on an afternoon back in April when he gave away hot dogs along Salem Avenue to celebrate his "retirement" from the towing business. The health department shut down the makeshift hot dog stand because Spanky had "neglected" to get a permit.
Lots of people have been asking for a Spanky Macher thread after Roanoke’s most prominent nose-thumber was arrested this morning on federal charges of tax evasion and bankruptcy fraud.
The oddest part to me, was this detail from the courtroom after Spanky’s arrest:
[U.S. Judge Magistrate Michael] Urbankski told Macher he had to “friend” his probation officer on social network websites. Macher said his daughter set up a Facebook page for him, but he didn’t know how to use it.
Is that the way the probation officers are managing their clientele these days?
Have at it, folks!

Poor Spanky. The Man just keeps on pushing him down! Tax evasion along the order of what was in the article is not good though. I wonder, has Wesley Snipes finished his sentence for it?

Comment by gdad — August 9, 2010 @ 3:48 pm
Dan,
You have to do a “Spanky’s” photo caption contest, so Tom can use his comment #8.
I have a couple of questions. Do they put you in leg irons no matter what the charge? Also, the judge told Spanky that “he had to “friend” his probation officer on social network websites.” That sounds weird. Is that something they only do here, or is that a new legal requirement everywhere?
Comment by Magpie — August 9, 2010 @ 3:53 pm

This guy should be known as “Shady” instead of Spanky… Roanoke should feel blessed that he will be visiting the “pokey” for a while… Maybe all the slum properties he owns will have to be sold to satisfy his Tax debt…

I do admire the “towing magnate” bit. There does seem to be a little more schadenfreude in this article than is called for. I hope he can write a check and make things right for himself and avoid prison time.
“Friending” probation officers?
Comment by Kristen — August 9, 2010 @ 4:52 pm
Love it.
All I can think of is, “What will Suzie say?” and from Spanky’s perspective, “Lance is worse, even if we don’t know the facts yet.”
Pass the tater chips.
Comment by Jeffrey King — August 9, 2010 @ 4:53 pm
This guy has been an enormous tool for a long time now. I used to do some freelance drafting work; he somehow got my number. He calls me up, out of the blue, DEMANDING that I drop what I’m doing and pick up his job. When I politely explained I couldn’t do it, he acted like I was obligated – kind of a “Don’t you know who I am?” sort of thing.
The Roanoke Valley would be a nicer place if this jackass would go away for a nice long while, but I’m sure he’ll weasel out of it somehow.

All the individual small business owners and good people that have encountered him over years finally get to see a good stab come his way. It’s just unbelievable that this man could come from a great willed family. Spanky should be sat on a polished rail and run off from this valley.
Comment by RkeLight — August 9, 2010 @ 5:41 pm
Magpie,
I don’t understand why they arrested the guy like they did. Why didn’t they call his lawyer, and have them meet the feds at the courthouse. It APPEARED to be grandstanding, although perhaps the federales are aware of something I’m not. Then again, Urbanski obviously doesn’d consider Spanky a flight risk. If he did he never would have let him go on a signature bond.
Comment by Dan Casey — August 9, 2010 @ 5:47 pm

First of all the facebook thing is really stupid, sounds like a democrat judge.(Hes a Fed judge, doubt if its a local thing..might just be an Urbanksy thing..)

This is disgusting. Do you not have a soul? I’ve gone to school with his children for many years. Did you ever stop to think of how this would effect them? Sure, Spanky did some bad things but this is hardly news. I’m sickened by the coverage his story is getting. My thoughts are with his family. Make a discussion board about this? I think you’re the one that needs the slap on the wrist.

Comment #33, if you’re a supporter then why remain anonymous? It is possible to have empathy for his family but not the man and his actions. If we deserve a slap on the wrist for having ill feelings toward an individual, what does Spanky deserve for his alleged crimes?
I’m just disappointed I can’t find him on Facebook and friend him too…. I wouldn’t want to miss a wall post from his PO…. ha!

Comment by TS — August 9, 2010 @ 7:12 pm
T. Witten, did you read the article? Macher’s attorney, Paul Dull, of Roanoke, said the indictment is no surprise. Federal authorities told Macher five years ago he was under investigation, Dull said.
The RT didn’t go after him, the Feds did. The paper reports on arrests everyday, Macher just happens to be more well known than most others are.
I rarely agree with Jack, but he’s right about this. He is innocent until proven guilty.

It’s one of those things where not a lot of folks like the guy. I guess that’s the best way to put it. There probably is somewhat more to the case that has been released at this point, yes, but Spanky is just the kind of guy folks WANT to arrest in public and put leg irons on. The fraud he committed was pretty blatant, and Spanky has been doing things that way his whole life. Karma is a mofo.

I worked for Spanky and his brother Richard. I personally was going to kick his back end from one part of the state to the other. Yes if you can’t tell I hate the fool!

No, Realist, this is the first time I’ve heard of leg irons being pretty standard for a post arrest hearing in any court. It is asinine.
I don’t know Macher, and, AFAIK, have never dealt with him or any of his businesses, but for a person who is about to released on a signature bond for this kind of crime, such restraints do nothing but create publicity that is unwarranted. They might also prejudice the case when it gets to court, if it does.
Leg irons on Morva are sensible. In this case, regardless of who or what the prosecutor is, they’re asinine showboating.
Comment by Charlie Self — August 10, 2010 @ 7:26 am

You were finished? Well, allow me to retort…I have never seen so much lawlessness wrapped up in one ‘businessman’ and his mother (‘SLM’ in the indictment; MMM is Margaret, the exwife) This isn’t the forum for details about the property rental, towing, used car, and judgment/debt collection business, or their lawyers. I would simply point out that South Carolina and California make it interstate. Oh, and let’s not forget Tanzania. His victims’ kids are just as innocent as his family’s. Brother, where ark thou?
Comment by Pitt — August 10, 2010 @ 8:44 am
I’m sorry to say, Spanky Macher has been involved in shady business dealings for decades. I know he is a popular personality amongst many people here in Roanoke, but Macher is getting his just dessert.
If you don’t want the government or “the man” to come down on your head, don’t give them any reason to do so and do what you’re legally supposed to do when running businesses.
Spanky’s business model has been to “get around this”, “get around that”, etc. All that “getting around” is finally catching up with him.
I have no pity for the man at all.
Comment by Sidney Vaught — August 10, 2010 @ 8:53 am
Spanky has done nothing except try to rewrite city codes and not abide by anyone’s rules except his own in any business he has owned. He had the rat infested restraunt downtown Roanoke. Towing without a license…The guy has potential to be a decent business owner. He needs to be held accountable to the law, maximum penalty for every charge. We know he will try to turn this to make it look like he is the victim. There are many of us business owners out here doing things by the rules…succesfully.

Popular? That’s definitely not the vibe I’m getting from this thread.
For those of you who have decided that everyone does the stuff Spanky’s accused of and his only issue is with being caught…I’ll tell you, I haven’t done any of them, and I’m sure plenty of people haven’t and still manage to get by.

The “EX” has done an outstanding job of protecting her children from this bi polar nightmare. She is in no way connected to this. She packed herself and her 3 children up and away from this man 14 years ago. Her children are bright, beautiful and smart individuals. They are completely aware of the fact that their Father is a nut case and a manipulator. They are strong enough to prevail through this as long as the fine folks of this Valley let them do so. Please be kind and keep them in mind when you go and slander their name. Believe me they are completely aware of the situation and do not need to be constantly reminded of the fact that their Father is who he is….I believe they know that by now.

Well, you know, Shakie Macher died in October 2009. Most of her area properties were conveyed from her to Macher Properties LLC by Spanky as her agent within days after her February 2009 will. It seems like one big ball of crazy resembling the twisted walls of that Taubman museum, where that antique mall once stood. Well…Looks like this party has just begun. To all the folks who have words to convey about Spanky on this thread: I have edited more posts on this thread than any other in the history of this blog. If you want to talk about the charges against Spanky, fine. If you want to say that you wouldn’t trust him with 10 cents of your own money, that is fine, too. It is a fact he’s been charged, by the feds, with tax evasion and bankruptcy fraud. It is your opinion that you would not trust him. I can live with either of those. What you can’t do here is accuse him of crimes that have no official (i.e. police or court) basis.
Comment by Dan Casey — August 10, 2010 @ 10:24 pm

I personally know Spanky and he is one of the kindest people I know. He would give you anything he has. I feel like Roanoke City has singled him out. For example, whoever heard of someone being “shut down for giving food to hungry people” or being giving this many city code violations, when there are people blatantly disobeying the city and they are over looked every day. Now they put him in shackles and chains for a white collar crime???? This is ridiculous!!!!

I don’t know Spanky Macher. Obviously he has stirred passions and ticked off a lot of people. But somehow all this piling on when the guy appears
to be down and out is a bit unseemly to me. Let the law take its course
and let him be punished if he’s found guilty. He will eventually answer
for whatever wrongs he has done to people and society one way or another.
IMO it’s time to stop the venting and get back to something more positive.

Maybe you should get out more, or arrested for Federal crimes more? Leg restraints are SOP while one is in Federal custody. At the time of the hearing Spanky was in Federal custody. It has nothing to do with who’s prosecuting him, it’s not showboating, it is S O P As soon as bond is granted, one is no longer in custody, leg irons come off. Simple, huh? Go watch the Marshalls service move anyone accused of any crime, guess what they’ll all be wearing?
Why is this such a problem for everyone?
Comment by Realist — August 11, 2010 @ 1:52 am
I’ll repeat what I said to Dan in an email. Spanky has generated a lot more negativity than that pudgy Nazi-wannabee slumlord did. Interesting.
To those who are so ardently and anonymously “defending” Spanky’s kids…no one has said a word about his family, and it’s a shame that he was not as protective of his children’s names as you seem to be.
Comment by Kristen — August 11, 2010 @ 8:41 am
Tyson does have a point. The City, the newspapers and certainly bloggers, all have their favorite “whipping boys”. They always have these headline grabbing, OMG, they did what? moments and then they are still walking the streets, trying to get buy just like the rest of us and if no one here can name a slumlord or someone they think might be a tax cheat, well that is one sheltered world you are living in.
Dan, national figures are fair game and a world removed, but adding salt into the wounds of a local (even a flagrant one) who may not be as guilty and awful as everyone thinks, is kinda unseemly. I do not know Mr. Macher and I do not care for Mayor Bowers, but I think we all know there are worse people, more destructive, manipulative and much heavier hitters in Roanoke we COULD rake over some coals. Some bloggers have proven they will trash just about anyone and the safety of anonymity makes that even sweeter, but it seems an ugly way to make a living IMO. Good muckrakers dig for the really ugly, badly needing to be exposed, not the low hanging doofus fruit.

Pretty standard? Well, are they or aren’t they? What is the determining criteria? I’ve seen people in Federal Court without the shackles.
“the guy prosecuting the case has been doing this for a minute, he’s pretty far past making a name for himself.”
I’m not very clear on your intent in that statement, but it appears we have a Cuccinelli wannabe in Roanoke. A task force for bankruptcy fraud? Must be slow in the drug business these days.

Our son once did some work for the man and when it came time to pay up our son presented a detailed listing of hours worked and supplies purchased. Spanky pulled out a thick wad of greenbacks and peeled off a few and said he could take it or leave it, not nearly covering what was due. He didn’t honor the agreement. That was the end to the working relationship.
No tears for the man here. Hope the judge treats him with the consideration he showed others along the years.

He needs to learn he is accountable for his actions.

The charges seem kinda week. If there was a crime why wait 5 years or more to file them. I know Spanky if the charges are valid, let justice be served. If not why spend the money to acomplish nothing. We are fit to judge nobody. All deeds are seen where it counts….
